China Privacy Notice
This China Privacy Notice (this "Notice") is provided as a supplement to the
Borouge Data Protection Notice and includes information about your rights under the Personal Information Protection Law of the People’s Republic of China
("China")("PIPL").
1. Collection and processing of personal data
Please refer to Sections 4 and 6 of the
Borouge Data Protection Notice for the types of personal data that Borouge may collect and the purposes for which Borouge processes your personal data.
Borouge generally does not collect sensitive personal data, unless otherwise permitted by law, or where required by a local authority or required by our relationship with you or in the performance of a contract and public tasks such as any disease control or prevention obligation. We will process sensitive personal data only if strict protection measures are put in place and there is sufficient necessity to justify the processing. If you do not want us to process your sensitive personal data, you may choose not to provide us with your sensitive personal data.
In some cases, we will also process your personal data indirectly from third parties, such as background check providers, recruitment agencies through which you have applied for a position in Borouge, and from publicly available sources such as employment- and business-orientated social networking services (such as LinkedIn and Glassdoor) and career fairs. This is to assess the suitability for the position that you have applied for.
We use your data for a number of processes for the purposes listed in the
Borouge Data Protection Notice, all of which are to enable Borouge to discharge its responsibilities as an employer to both the individual and any statutory body as required including any People’s Republic of China Government Department or legislative body that Borouge receives the request from.
2. Legal basis for data processing
We may process your personal data based on one or more of the legal bases specified in Article 13 of the PIPL. We will not, however, process your personal data in a way prohibited by or not compliant with the PIPL.
3. Sharing and transfer of personal data
We may share your personal data with companies in the Borouge Group, our holding companies and their subsidiaries, service providers and other third parties located in various jurisdictions for the purposes and in a manner specified in Section 7 of the
Borouge Data Protection Notice. If we share your personal data with the foregoing recipients, we will follow and adopt the applicable process and requirements required by the applicable law in respect of the transfer (including international transfer) of your personal data.
4.Your rights and how to contact us
In addition to the rights specified in Section 12 of the
Borouge Data Protection Notice, according to the PIPL, you may also have the right to request explanations of the rules governing the processing of your personal data.
To exercise any of your rights in relation to your data, to enquire on any aspect of this Notice or your personal data, or provide us with any feedback, you may contact us at the contact details specified in Section 13 of the
Borouge Data Protection Notice.
By providing your personal data to us, you will be deemed as having accepted and fully agreed to be bound by, and you consent to our processing of your personal data in accordance with the terms and conditions set out in the
Borouge Data Protection Notice and this Notice, including our processing of your sensitive personal data (if applicable), our sharing your personal data with the aforementioned parties for the purposes described in the
Borouge Data Protection Notice and this Notice.
